Several conservative justices β including Chief Justice Roberts and Justices Alito, Barrett, and Kavanaugh β signaled sympathy with the administration’s core argument that courts cannot review TPS termination decisions. In a rare bipartisan rebuke, the U.S. House of Representatives passed H.R. 1689 by a vote of 224 to 204 on April 16, 2026. The bill would require DHS to designate Haiti for TPS through April 20, 2029. The bill now goes to the Senate, where prospects are uncertain.

USCIS issued updated guidance extending Haiti TPS Employment Authorization Documents to July 1, 2026. Applies to EADs with codes A-12 or C-19. For Form I-9: Section 1 write “as per court order” Β· Section 2 write “July 1, 2026.” Employers must accept facially expired EADs extended by court order.
